Proposed Initiatives to the Legislature - 2001

The following is a list of proposed initiatives to the Legislature filed to date with the Office of the Secretary of State. To be certified, a petition must contain the signatures of at least 197,734 registered voters. The deadline for filing petition signatures for the following initiatives is 5:00 p.m. January 4, 2002. Questions regarding the content of initiatives should be directed to the sponsor(s).

NOTE: Initiative numbers are not assigned until the proposal has been reviewed by the state Code Reviser and the sponsor has submitted the final language of the proposed initiative. The content of initiatives is described as general "subject matter" pending the issuance of an official ballot title and summary by the state Attorney General.

Ballot Title
Initiative Measure No. 254 concerns requirements that food producers and distributors label genetically engineered food.

This measure would require labeling on human or animal food which contains genetically engineered material, or is produced with genetically engineered material. The measure would specify labeling content and would allow certain exceptions.

Ballot Measure Summary
This measure would require labeling of foods distributed in or from Washington for human or animal consumption which contain or are produced with genetically engineered material. Genetically engineered foods altered in composition or nutritional value would be required to bear a label specifying the changes. If food contains genetic material from another species, the source species and purpose of the transfer must be specified. The measure specifies exceptions for restaurant food and certain other categories

Initiative Measure No. 255 concerns the display and distribution of sexually explicit material and performances.

This measure would make it a gross misdemeanor to display or distribute, to children under eighteen, sexual material defined as "harmful to minors." Certain defenses would apply. Inconsistent local laws would be preempted.

This measure would define certain sexually explicit materials and performances as "harmful to minors." It would a gross misdemeanor to display such material where minors could view it, or to provide minors with access to such matter or performances. Certain affirmative defenses would be allowed, such as dissemination by or with the written permission of the minor's guardian or parent, for a bona fide purpose. Inconsistent local laws and ordinances would be preempted.

Ballot Title
Initiative Measure No. 256 concerns property forfeiture arising from controlled substances crimes.

This measure would make numerous changes to laws forfeiting property connected with drug crimes, including a requirement of conviction of all owners, additional hearings, and requiring sale, not government use, of forfeited property.

Ballot Measure Summary
This measure would require conviction of all owners before property is forfeited. It would require earlier notice to property owners, increase the proof required to forfeit proceeds of controlled substance crimes and transfers of forfeitable property. An owner or claimant could request a preliminary hearing beyond hearings authorized by current law. Seizing law enforcement agencies could not use forfeited property. Sale proceeds would be allocated to common school fund and drug treatment programs.

Ballot Title
Initiative Measure No. 257 concerns performance audits conducted by the state auditor.

This measure would direct the state auditor to conduct performance audits of state agencies and institutions. A citizens' oversight committee would be created, and $3 million would be appropriated for the current biennium.

Ballot Measure Summary
This measure would direct the state auditor to undertake performance audits of state agencies, including higher education institutions. The audits would include recommendations for potential cost savings, elimination or reduction of programs, and correcting gaps and overlaps in functions. A citizens' oversight committee of five members, appointed by certain legislative leaders, would make recommendations to the auditor about the initiation and scope of performance audits. Three million dollars would be appropriated for the 2001-2003 biennium.

This measure would require the dissolution of Sound Transit, a regional transit authority previously established in King, Pierce, and Snohomish Counties. Remaining Sound Transit money would be transferred to the state transportation fund.

This measure concerns Sound Transit, a regional transportation authority previously established pursuant to law and operating in parts of King, Pierce, and Snohomish Counties. This measure would require that Sound Transit be dissolved by December 31, 2002. All remaining Sound Transit funds would be transferred to the state transportation fund and applied to the state transportation budget.

Initiative Measure No. 260 concerns limiting taxes and fees on motor vehicles and light trucks.

This measure would require license tab fees to be $30 per year for motor vehicles and light trucks. Certain excise taxes and fees imposed on motor vehicles for transportation purposes would be repealed.

Ballot Measure Summary
This measure requires license tab fees of $30 per year for motor vehicles such as cars, sport utility vehicles, motorcycles, motor homes, and light trucks. The measure would repeal certain existing laws that allow cities, counties, transportation benefit areas, and regional transit authorities to impose taxes or fees on motor vehicles for transportation purposes. The measure would direct that any bonds previously issued for light rail be retired using reserve funds and other revenue sources.
